It is specifically designed for people who are not eligible for a refugee status determination but who may still face risks if returned to their home country.<\/p>\n<p>The PRRA assesses whether there are grounds to believe that a person would face persecution, torture, or risk to their life upon removal. This process typically involves the following steps:<\/p>\n<ol>\n<li>\n<p><strong>Eligibility<\/strong>: Not everyone can apply for a PRRA; it usually applies to individuals who are in Canada and have already received a negative decision on their refugee claim or who have not been able to make a refugee claim.<\/p>\n<\/li>\n<li>\n<p><strong>Application<\/strong>: Applicants must submit their PRRA application, including detailed information about their situation and the risks they may face if returned.<\/p>\n<\/li>\n<li>\n<p><strong>Assessment<\/strong>: Immigration, Refugees and Citizenship Canada (IRCC) reviews the application, considering country conditions and personal circumstances.<\/p>\n<\/li>\n<li>\n<p><strong>Decision<\/strong>: A decision is made based on the evidence provided. During this meeting, you may receive a PRRA application if you qualify.<\/p>\n<p>Should you decide to apply for a PRRA, you must submit your application within 15 days of receiving it (your removal will be paused once your PRRA application is submitted). You will then have an additional 15 days to provide written submissions and supporting documents to a PRRA officer.<\/p>\n<p>\u00a0<\/p>\n<h5><strong>How Do I Apply for Pre-Removal Risk Assessment in Canada?<\/strong><\/h5>\n<p>\u00a0<\/p>\n<p>The Pre-Removal Risk Assessment (PRRA) is back-ended application for protection that enables Canada to meet its obligations under the Convention Against Torture (CAT). The CAT prohibits all refoulement (return) to a country where a person is at risk of torture or cruel or unusual treatment or punishment. By offering persons in Canada the opportunity to apply for such protection prior to being removed to their home country, Canada abides by CAT.<\/p>\n<p>The unfortunate reality is that PRRA applications have a very low success rate: 2 to 4% country-wide. There are numerous reasons for this:<\/p>\n<ul>\n<li>you can only submit evidence that has arisen since your refugee claim, if you have had one; if you haven&#8217;t submitted a refugee claim, you can submit any evidence;<\/li>\n<li>you must show that the risk is personalized, that is, that you as a person are likely to suffer the risk;<\/li>\n<li>if you come from a country where large areas of the country are at risk due to civil war, famine or drought, you are precluded from making that argument in your PRRA;<\/li>\n<li>if you are claiming protection because your country is unable or unwilling to provide for your medical care, even life-sustaining medical treatment, you are again precluded from making that argument in your PRRA, unless you are being singled out by the government by discriminatory treatment.<\/li>\n<\/ul>\n<p>Canada has both constitutional and international obligations that prevent you from being removed to a country where you could face danger or persecution. If you are facing removal from Canada, you may qualify for a Pre-Removal Risk Assessment (PRRA).
